LATEST NEWS! U.S. EPA grants ARB authorization to enforce the TRU ATCM.
On January 9, 2009, U.S. EPA approved ARB's request for authorization to enforce the TRU ATCM, also known as a waiver from preemption. This decision was published in the Federal Register on January 16, 2009 (see Federal Register, Vol. 74, No. 11, Friday January 16, 2009, Notices, pages 3030–3033). This decision
affects not only persons in California, but also persons outside the State who would need to comply with California's TRU ATCM regulations to enter California with TRU engines. Therefore this action has national applicability. ARB has delayed the enforcement of the first phase of the TRU ATCM's in-use performance standards for six months from the publication date. Therefore, the six-month enforcement grace period for TRU engine model years 2001 and older will end on July 16, 2009, and
enforcement of the in-use performance standards for these model years will begin on July 17, 2009.

- Review your TRU engine and TRU genset engine inventory.
- For each TRU determine the engine model, model year, rated horsepower, and serial number

Apply for ARB ID numbers
IDNs are mandatory for California-based TRUs and TRU generator sets. They are
voluntary for TRUs that are based outside of California, but operate in California.
We recommend ARB ID numbers for all equipment that may operate in California. This will make inspection quicker and eliminate delays at California terminals and border crossings.
You will need general business information such as your Business Name, Federal Tax Identification Number, and other business information such as mailing address and company contacts. You will be required to submit detailed information about your equipment. We are available to help with this paperwork at any time.
CARB PROHIBITIONS
Once a compliance deadline passes for a TRU or TRU genset model year,
it is illegal to
sell, offer for sale, lease, offer to lease, rent, or offer to rent a TRU for use in California
that does not meet the in-use performance standards in the ATCM. Owners still have
options for dealing with noncompliant TRUs or TRU gensets.
Manufacturers, dealers, and distributors can sell, lease, or rent them outside of
California, but must make every reasonable effort to ensure that the new owner is
appraised that they cannot operate them in California.
